Patient lawsuit against IDSA and insurers moves forward in Texas

By Mary Beth Pfeiffer

A federal lawsuit that may just validate the pain of thousands of Lyme disease patients – and the flaws in prevailing tests and treatments — is moving ahead in a Texas courthouse, despite attempts to kill it.

The lawsuit’s progress is a big development in the decades-old struggle of patients whose post-treatment conditions – involving myriad neurological, cognitive, musculoskeletal, and cardiac symptoms — have long been misdiagnosedand minimized. Patients have hence had to seek out-of-pocket treatment from physicians who risk their licenses providing it.

The suit, Torrey v. Infectious Diseases Society of America et al, aims to change that, and, make no mistake, is a serious challenge to the Lyme status quo (see myarticle from 2017).

In the crosshairs of the case are six major architects and proponents of the guidelinesthat have dogmatically ruled Lyme disease care for two decades: Raymond J. Dattwyler, John J. Halperin, Eugene Shapiro, Leonard Sigal, Allen Steere, and Gary P. Wormser. (A seventh, Robert Nadelman, died in 2018.)

Beyond that A-list of Lyme actors, the lawsuit also accuses eight insurers of conspiring with the IDSA and the Lyme architects to advance treatment protocols that limited care options to the 25 named plaintiffs, two deceased, for whom the protocols did not work.

The companies are Blue Cross And Blue Shield Association, Anthem, Inc., Blue Cross And Blue Shield Of Texas, Aetna Inc., Cigna Corporation, Kaiser Permanente, Inc., United Healthcare Services, Inc., and Unitedhealth Group Incorporated.

Here’s what will happen shortly

A hearing on a second motion to dismiss the case will be held on March 11, at 2 p.m., at the U.S. Federal Courthouse, 500 North State Line Avenue, Texarkana, Texas. [Note: this story was edited on 2/27 to reflect the hearing’s recent date change.]

The suit, whose lead plaintiff is Texas resident Lisa Torrey, already survived one motion to dismiss. (See below.)

I’d encourage people who are invested in the outcome of the case to attend. Lyme patients have been portrayed, wrongly, as deluded, unpleasant and aggressive for a long time. Show them who you really are: Informed, concerned, intensely interested, and respectful of the court’s crucial role. Now’s the time.

Here’s what’s happened so far

The judge in part granted and in part denied a previous motion to dismiss the case.

In favor of the IDSA-insurers side, the judge agreed that the lawsuit did not sufficiently describe the alleged fraud that it maintains was committed by the defendants under theRacketeer Influenced and Corrupt Organizations Act (RICO).

The court, however, ruled the patients’ side could redraft the complaint under RICO. A request for an extension to do that will be among the issues considered at the March 12 hearing.

But the motion to dismiss was largely decided in favor of patients, including on the crucial assertion that the defendants violated anti-trust statutes under the Sherman Act.

As the judge put it, summarizing the case,

“Defendants [as alleged] engaged in a conspiracy to unreasonably restrain trade in the relevant market—the Lyme disease treatment market—by paying large consulting fees to the IDSA Panelists to pass the IDSA guidelines which deny the existence of chronic Lyme disease and establish the standard that all Lyme disease is cured with short-term antibiotics.”

Insurers then were able to deny claims, and doctors who treated outside the guidelines were marginalized in what became a monopolistic marketplace, the suit maintains.

In upholding the suit’s anti-trust assertion, the judge wrote:

“Plaintiffs have sufficiently alleged that, in the absence of the IDSA, there would be competition among doctors for the treatment of chronic Lyme disease and competition among insurance carriers for coverage for such treatments. Similarly, Plaintiffs have alleged that Defendants’ adoption of the IDSA guidelines and standard of care for the testing, diagnosis and treatment of Lyme disease has harmed patients and doctors nationwide. … The Court finds a nationwide geographic market has been properly alleged.”

All of this, of course, must be proven at trial.

There’s more

Beyond this, the judge granted the plaintiffs’ request for discovery, but so far it has been limited only to documents from four years before the lawsuit’s filing. The judge wrote, in reference to whether the court has jurisdiction to order discovery:

“The Court finds that Plaintiffs have pointed to enough evidence preliminarily establishing personal jurisdiction over the IDSA Panelists to warrant jurisdictional discovery. Specifically, Plaintiffs point to the declarations provided by each of the IDSA Panelists in which each doctor attests to having visited Texas for professional purposes during the relevant time periods. …Moreover, Plaintiffs have established that the IDSA Panelists’ research and professional activities focus primarily on Lyme disease.”

In a filing Friday, the Torrey lawyers called the four-year timeframe “arbitrary.”

Here’s what is pending

Among the issues that the hearing will consider is whether, essentially, to put chronic Lyme disease on trial. A motion by Anthem, Inc., the IDSA, and what is termed the “Doctor Defendants” asks the court to have all plaintiffs submit to independent medical examinations, or IMEs, by a Texarkana-based infectious diseases physician.

Their motion, which has been challenged by the plaintiffs’ attorneys, states:

“The Lyme Claimants allege that they have suffered debilitating injuries because they have been denied appropriate medical treatments for so-called ‘chronic Lyme disease,’ allegedly due to an unlawful conspiracy among the Defendants to monopolize the treatment of Lyme disease. … Nearly all of the Lyme Claimants allege that they still suffer from the disease today and many claim that they are currently disabled or otherwise unable to work due to their illness. … (W)hether they currently or have ever suffered from Lyme disease, the severity of their symptoms, and whether those symptoms are attributable to Lyme disease or some other cause, are at the heart of this case and were put into controversy by the Lyme Claimants themselves. Well-prepared, peer-reviewed studies have established that as many as 88% of patients who have been told they have ‘chronic Lyme disease’ either do not have – or, in many cases, never have had – Lyme disease in any form.”

To support their assertion, the IDSA defendants cite an articleon chronic Lyme disease by Duke University physician of pediatric medicine, Paul Lantos, which cites much of the Doctor Defendants’ research.

And finally…

The hearing will also take up another request related to whether the patients are truly ill and with what.

The IDSA is seeking emails written by them – including any in which the words Lyme appear coupled with antibiotic, literate, chronic, claim*, cover* and den* (presumably meant to refer to claimed/claimant, coverage, denied or denial). Emails with the initials IDSA are also sought.

In its motion, the IDSA asserts:

“Defendants’ email requests seek information relevant to the claims and defenses in this action. In the Complaint, Plaintiffs assert that they ‘suffer debilitating injuries’ and that such injuries impact them on a daily basis, including cognitive deficits, fatigue, and memory loss, resulting in a multitude of alleged harms, including the loss of careers, homes, and the ability to function. … Plaintiffs’ communications about their condition go to the heart of corroborating or refuting their allegations about their conditions and the harms that they allege they have suffered.”

The calendar for the lawsuit lists June 24, 2019 as the start of a jury trial in Torrey v. IDSA et al. Stay tuned.

Powassan Virus on the Up-tick

Powassan virus on the up-tick

Paul Smith’s research shows spread risks funding cut

PAUL SMITHS — A group of Paul Smith’s College students, researching the tick-borne Powassan virus for the state, has discovered that the disease is prevalent throughout the North Country.

Though professor Lee Ann Sporn said research on the Powassan spread is just starting, the group may lose its state funding in March.

The students, who are the first and only researchers of Powassan in the North Country, found that around 25 to 50 percent of deer in the northern half of the Adirondacks tested positive for exposure to Powassan, less than 25 percent were exposed in the southern and most eastern parts and 75 to 100 percent were exposed in the western edge.

“This was completely student driven,” Sporn said. “The state Department of Health was incredibly pleased with what we were able to do.”

The study involved students — funded by the state Senate Task Force on Lyme and other Tick Borne Diseases, and doing research through the Adirondack Watershed Institute — working with deer processors and hunters from St. Lawrence, Franklin, Essex, Clinton, Washington and Warren counties to establish the northern edge of the Powassan virus’ reach.

The pipette and vial used to take a sample of deer blood come in a kit with rubber gloves and a cloth. These kits were used by Paul Smith’s College students to research the tick-borne Powassan virus. (Enterprise photo — Aaron Cerbone)

“The punchline is there really wasn’t a northern edge,” Sporn said.

Powassan does not affect everyone exposed to it, but the ones who are effected can develop a serious brain infection, for which there is no vaccine or antibodies. Powassan has a 10 percent mortality rate, mimics dengue and can be misdiagnosed as the flu. Those who recover from it can often have neurological damage.

The transfer of Powassan from a tick to a human can take as little as 15 minutes.

Powassan is often found in the ticks and deer of southern New York. However, until around two years ago it was unheard of in the North Country.

“It’s probably driven by climate change,” Sporn said of the northward crawl. “Warmer and wetter, with less extended periods of cold.

“In some areas of the state (the south) nearly all deer have antibodies to Powassan,” Sporn continued.

Despite its high prevalence in deer, Powassan is rarely found in humans.

There are under 50 human cases of Powassan ever recorded in New York. However, nine of those were in the past two years, including three in Saratoga County in 2017, one which was fatal.

Powassan-carrying ticks are also pretty rare. Sporn estimates that less than 1 percent are positive in the Tri-Lakes area.

Students tested deer blood because it acts as a sentinel for Powassan in the area. Deer can be bit by thousands of ticks over their lifetime, and once a tick with Powassan bites a deer the deer creates antibodies in its blood which last the rest of its life.

The blood came from samples collected by processors such as Woods and Water and Blue Line Sports, outdoors stores in Saranac Lake, individual hunters and processors around the North Country. Sporn said she wanted to thank everyone that contributed to the study because she was able to get around 100 samples, evenly spread around the park.

“We wouldn’t have done that without the processors,” Sporn said. “What they did provided so much important information.”

Sporn said she doesn’t want this new information to cause panic, but said people shouldn’t be cavalier about it either.

“It doesn’t mean that people are going to get the disease, because there are other places where ticks test positive and no human cases show up,”Sporn said. “No one really understands the relationship between positive ticks, positive deer and human cases.

“Just because you’re exposed doesn’t mean you’re going to get sick,” she added. “The risk to humans is incredibly low.”

To avoid being bitten, Sporn recommends dressing to cover all lower body skin, wearing repellents and being knowledgeable of where ticks will be.

She said to tuck pants into socks, wear light colors to easily see ticks and be aware when walking through high grasses. She said the locally made repellent Wild Wood is effective.

Sporn said it is okay to eat and touch deer infected with it.

Funding troubles

The study was funded through the state Senate Task Force on Lyme and other Tick Borne Diseases, a Republican initiative, with the support of state Sen. Betty Little, R-Queensbury. It is up to the majority party to organize the task force. Democrats took the Senate majority in last year’s election and has not done that yet.

Last year Sporn said she received $30,000 in funding from the task force, including $5,000 for the Powassan project. She is asking for the same level of funding this year.

Sporn said she has been contacting Senate Democrats using a list supplied by Little. Funding will need to be secured for the task force and research by the time the state’s budget is voted on April 1.

Sporn said this research is important for human health in New York, and that it is about catching things early and preempting a health emergency. She wants to research the spread of the virus for several years to see what patterns emerge.

“If you don’t watch over a long time, you may never see that happen,”Sporn said. “I really wish we had done this a few years ago.”

The project also translates its results into public information and literature provided to health clinics and medical professionals to educate them and the public about tick-borne diseases. There is a fair amount of rejection of the research that shows Lyme disease has spread into the Adirondacks by the medical community.

“That’s just kind of human nature, for people to resist the change,” Sporn said.

Sporn said she has talked with the Cloudsplitter Foundation about continuing with private funding. She said the Paul Smith’s students have created a good model for other schools to use to research Powassan or other tick-borne illnesses. She said she has not seen research on if the virus has spread into Vermont or Canada.

Climate change has nothing to do with this:  https://madisonarealymesupportgroup.com/2018/08/13/study-shows-lyme-not-propelled-by-climate-change/  In this link there is a video showing ticks surviving 3 degrees in snow cover.  Canadian tick researcher, John Scott, has disproven the climate change theory regarding tick expansion and pathogen expansion.  He found that photo-period and songbird migration are behind it.

His study summed up:

  • during bad weather ticks adapt by finding cover
  • warmer temperatures actually reduce tick populations
  • temperature and precipitation have no bearing on tick abundance
  • climate change alarmists have used Canadian studies making 1970 their benchmark for models but didn’t take into account established tick populations that had already been in existence for decades, centuries, or even millennia at northern latitudes
  • Black-legged ticks require 14 hours of daylight to molt.  Photoperiod is innate and can not be altered by the climate
  • Yearly bidirectional, songbird migration in spring and fall is behind tick expansion and the climate change model actually reflects migratory flight not warmer futuristic temperatures

Although Scott’s study specifically deals with Lyme disease, tick and pathogen spread is the same regardless of the disease.

Scott’s study:  https://madisonarealymesupportgroup.com/wp-content/uploads/2018/08/scott-scott-2018-ticks-and-climate-change-jvsm.pdf

For an interview with Scott:  https://madisonarealymesupportgroup.com/2017/08/14/canadian-tick-expert-climate-change-is-not-behind-lyme-disease/

“The climate change range expansion model is what the authorities have been using to rationalize how they have done nothing for more than thirty years. It’s a huge cover-up scheme that goes back to the 1980’s. The grandiose scheme was a nefarious plot to let doctors off the hook from having to deal with this debilitating disease. I caught onto it very quickly. Most people have been victims of it ever since.  This climate change ‘theory’ is all part of a well-planned scheme. Even the ticks are smarter than the people who’ve concocted this thing.  Climate change has nothing to do with tick movement. Blacklegged ticks are ecoadaptive, and tolerate wide temperature fluctuations…..It’s all a red herring to divert your attention.”- John Scott

Due to this research, researchers need to quit going down the rabbit-hole of climate change as it has not and will not help patients one iota.

Mic-drop at the ACIP CDC Meeting -Vaccine Science NOT Settled

 Approx. 3.5 Min

Del Bigtree unloaded some major truth bombs in front of the recent ACIP CDC meetings. Despite this truth, these Pharma trolls approved all the new vaccines including anthrax for children. It’s a must watch.

All he needed was a microphone to drop at the end.

There is only ONE study on vaccinated vs unvaccinated children:  https://madisonarealymesupportgroup.com/2017/05/18/first-peer-reviewed-study-of-vaccinated-vs-unvaccinated-children/  Excerpt:

The first peer-reviewed study comparing health outcomes of vaccinated versus unvaccinated children implicates vaccines in a host of chronic illnesses.  http://oatext.com/pdf/JTS-3-186.pdfScientists found no significant differences in rates of vaccine-preventable illnesses like hepatitis A or B, measles, mumps, rubella, influenza, meningitis or rotavirus.  As would be expected, vaccinated children did have lower likelihood of two vaccine-preventable illnesses compared to unvaccinated children: chicken pox (7.9% vs. 25.3%), and pertussis (2.5% vs. 8.4%).

The study suggests that fully vaccinated children may be trading the prevention of certain acute illnesses (chicken pox, pertussis) for more chronic illnesses and neurodevelopmental disorders like ADHD and Autism. The scientists also found that children born prematurely, who were vaccinated, were 6.6 times more likely to have a neurodevelopmental disorder.

Must See Video. Hippocratic Oath: 1st Do No Harm & Patient Confidentiality

 Approx. 25 Min.

The Hippocratic Oath is between the doctor and the patient – not the government, CDC, or FDA.  The relationship between doctor and patient is private and exclusive.

In this interview with Dr. Phan, he tells his unique perspective of escaping Vietnam at eight years of age in 1975 after the Communist take over. For a year he protected his two year old brother until they were finally reunited with his parents.  His parents, having lived under a totalitarian regime taught him that a system that dictates what you should think, read, and eat, is wrong.

Later, when Dr. Phan went to medical school, vaccines were recommended, but med students never had lessons on vaccine side effects. He never read a package insert.  https://madisonarealymesupportgroup.com/2018/10/08/vaccine-safety-efficacy-studies-that-are-the-bases-for-marketing-authorizations-are-a-complete-methodological-mess/

Richard Horton, editor in chief of The Lancet said this in 2015:

The case against science is straightforward: much of the scientific literature, perhaps half, may simply be untrue.  https://madisonarealymesupportgroup.com/2018/06/21/the-corruption-of-evidence-based-medicine-killing-for-profit/

His mentor warned him that when he began to see pharmaceutical companies getting in bed with the government and the health industry he would need to make a decision about how medical career – either retire or fight it.  https://madisonarealymesupportgroup.com/2019/02/11/industry-sponsored-doctors-new-study-shows-depth-of-commercial-influence/

After his patients reported illness after getting vaccinated, he studied the literature for himself and discovered Mercury is really bad inside the brain – from mercury fillings and from vaccines.

He found the CDC studies to be little more than propaganda.

He states there is a financial incentive for pediatricians to complete the vaccine schedule.  For more on that:  https://madisonarealymesupportgroup.com/2018/08/24/financial-kickbacks-for-vaccinations-abusive-illegal-fraudulent/

He challenges doctors to watch the documentary VAXXED.  He feels it imperative that doctors take it upon themselves to become educated because enemies are infiltrating medical and dental schools and are teaching doctors to flatly dismiss parents’ questions about vaccinations and just give the shots anyway despite the outcome.

He admonishes doctors to stand up and stop the totalitarian bullying regarding vaccines.

According to Phan, doctors are continually barraged by regulations, particularly Obamacare.  One of Dr. Phan’s professors gave a quote from Lenin:

“The key to a socialized state is socialized medicine.”

Dr. Phan practices medicine in the state of California and continually gets letters from Medicare and insurance companies pushing him to give prescriptions and vaccines.  He also gets threatening letters from Medicare asking him to give up his patient records – which would require him to break the second rule of the Hippocratic Oath:  patient privacy.  This is something Dr. Phan doggedly refuses to do.

A CEO of an insurance company who is also a MD visited Dr. Phan and asked why he continued to resist giving his patient records.  Phan responded that he would be breaking the 2nd rule of medicine and that as a MD he should understand that.  He also stated the CEO was no longer a doctor if he had no problem ignoring patient confidentiality. Due to his resistance, the CEO announced the insurance company would leave him alone.  That was three years ago and the CEO has kept his word.

Dr. Phan recommends doctors reread the Hippocratic Oath to understand their true responsibilities and then to join him in standing up to these totalitarian mandates and regulations.

He also reminds us that after the war in Vietnam it was the ex-military, teachers, and doctors, who were rounded up and sent to the concentration camps.  They were never seen again.
The Hippocratic Oath

https://www.britannica.com/topic/Hippocratic-oath  The text of the Hippocratic Oath (c. 400 BC) provided below is a translation from Greek by Francis Adams (1849). It is considered a classical version and differs from contemporary versions, which are reviewed and revised frequently to fit with changes in modern medical practice.

I swear by Apollo the physician, and Aesculapius, and Health, and All-heal, and all the gods and goddesses, that, according to my ability and judgment, I will keep this Oath and this stipulation—to reckon him who taught me this Art equally dear to me as my parents, to share my substance with him, and relieve his necessities if required; to look upon his offspring in the same footing as my own brothers, and to teach them this Art, if they shall wish to learn it, without fee or stipulation; and that by precept, lecture, and every other mode of instruction, I will impart a knowledge of the Art to my own sons, and those of my teachers, and to disciples bound by a stipulation and oath according to the law of medicine, but to none others. I will follow that system of regimen which, according to my ability and judgment, I consider for the benefit of my patients, and abstain from whatever is deleterious and mischievous. I will give no deadly medicine to any one if asked, nor suggest any such counsel; and in like manner I will not give to a woman a pessary to produce abortion. With purity and with holiness I will pass my life and practice my Art. I will not cut persons laboring under the stone, but will leave this to be done by men who are practitioners of this work. Into whatever houses I enter, I will go into them for the benefit of the sick, and will abstain from every voluntary act of mischief and corruption; and, further from the seduction of females or males, of freemen and slaves. Whatever, in connection with my professional practice or not, in connection with it, I see or hear, in the life of men, which ought not to be spoken of abroad, I will not divulge, as reckoning that all such should be kept secret. While I continue to keep this Oath unviolated, may it be granted to me to enjoy life and the practice of the art, respected by all men, in all times! But should I trespass and violate this Oath, may the reverse be my lot!  This article was most recently revised and updated by Kara Rogers, Senior Editor.

Fantastic reminder and history lesson.

Q: Is it dangerous to use this vaccine with other vaccines?

A: We have no data on that. Once approved, it will be given along with other vaccines but we have no clue whether that’s safe or not.

Somehow approving a new vaccine with no data on the accumulated cocktail effect is OK to them IF you put them in different limbs……scientifically, this is quite a head scratcher.  By nature, vaccines are systemic.

Q: Do we at least have any data from other countries that used this vaccine in combination with other vaccines?

A: Not to my knowledge.
